A Seller’s Guide to Listing Agreements

Signing an Agreement

If you choose to work with a real estate professional to sell your home in Northeast Florida, one of the first steps is negotiating and signing a listing agreement with your selected agent. Here’s what you need to know:

What is a listing agreement?
A listing agreement is a contract between you and your agent. It authorizes your agent to represent you and market your property to buyers and other agents, sets the sales price for your home, and outlines the services the agent will provide. Compensation is fully negotiable and is not set by law.

What are my options for agent representation in Northeast Florida?
Some of the most common arrangements include:

  • Exclusive Agency Listing Agreement: You work with a single agent and agree to compensate them if they sell your home. You retain the right to sell your home yourself without paying the agent.
  • Exclusive Right-to-Sell Listing Agreement: You work with one agent, but are responsible for paying the agent’s compensation regardless of who sells the property.
  • Limited-Service Listing Agreement: You work with one agent who provides a limited set of services, such as listing your home on the MLS but not arranging showings or assisting in negotiations.
  • Non-Exclusive Listing Agreement: You may work with multiple agents and agree to pay the agent who sells your home.

What services might be included in a listing agreement?
Your listing agreement may include:

  • MLS listing on local systems (e.g., realMLS for Duval, Clay, St. Johns, Nassau, Baker counties)
  • Marketing your home online and offline, including seller concessions and offers of compensation to buyer’s agents
  • Guidance on staging and preparing your home for showings
  • Coordination of open houses and property tours

Are offers of compensation mandatory?
No. You decide if making or authorizing an offer of compensation is the best approach for your property. REALTOR® agents can provide guidance to help you make an informed decision.

How do I know what will work best for me?
